Appellant was convicted by a jury of murder, V.T.C.A. Penal Code 19.02(a), and the trial judge assessed punishment at confinement for 15 years in the Texas Department of Corrections and restitution of $1,300. On direct appeal, the court of appeals found the evidence insufficient to support the conviction because the State failed to disprove appellants defense of self-defense beyond a reasonable doubt. Saxton v. State, 776 S.W.2d 685 (Tex.App. - Houston [14th Dist.] 1989). The appellate court therefore reversed appellants conviction and rendered a judgment of acquittal. Id. at 689. We granted the States petition for discretionary review to determine whether the court of appeals erred in finding the evidence was insufficient. Tex.R.App.Proc. 200(c)(5) and (6). We will reverse and remand.
